Terms of service
"Motacilla alba DG", LV40203579966, Ogres nov., Ikšķile, Tīnūžu šoseja 17, LV-5052, Latvia, hereinafter referred to as the Online Store, provides content available on the website and offers goods/services in accordance with the Terms of Use outlined below.
1. General Terms
If a consumer purchases goods/services via the website, such a mutual agreement is considered a Distance Contract and is subject to the legal norms of the Republic of Latvia regulating distance contracts, including but not limited to the Consumer Rights Protection Law of the Republic of Latvia, the Cabinet of Ministers Regulations on Distance Contracts, and other applicable laws.
2. Making a Purchase
The prices and specifications of products sold in the online store are indicated next to the respective products.
To place an order:
- Add the desired products to the shopping cart.
- Fill in all the required fields and select the preferred delivery method.
- The total order cost, including delivery, will then be displayed on the screen.
- Complete the payment to finalize the order.
3. Payment Terms
The currency used on the website is Euro (EUR). Purchases can be paid using the following payment methods provided by the payment platform makecommerce.lv, Maksekeskus AS:
- Latvian online banking payments: Swedbank, SEB, Citadele, and Luminor
- Estonian online banking payments: Swedbank, SEB, Luminor
- Lithuanian online banking payments: Swedbank, SEB, Luminor
- Finnish online banking payments: Aktia, Ålandsbanken, Danske, Handelsbanken, Nordea, Oma Säästopankki, Pohjola, POP Pankki, S-Pankki, Säästopankki
- Visa/Mastercard card payments
NB! When using the online banking payment method, confirm your order and click on the "Return to Merchant" button.
Personal data required for payment processing is transferred to the licensed payment institution Maksekeskus AS.
The agreement enters into force upon successful payment to the online store’s bank account. If, for any reason, the order cannot be fulfilled, the Buyer will be informed, and the paid amount will be refunded as soon as possible, but no later than 14 days after the notification.
4. Delivery Terms
Products are delivered to all countries worldwide. Purchased goods are shipped using parcel delivery partners (Omniva, DPD), courier services, or in-store pickup.
All duties and taxes required to receive the shipment at the delivery destination must be covered by the Buyer. Delivery costs are displayed before order confirmation.
Orders are delivered to the Buyer's specified address within 3-7 business days. In exceptional cases, we reserve the right to extend delivery up to 45 calendar days, informing the customer accordingly.
5. Right of Withdrawal
The Buyer has the right to withdraw from the purchase within 14 calendar days from the date of receipt. (Depending on the type of product, the right of withdrawal may not apply; in such cases, the reason must be clearly stated and explained.) The right of withdrawal does not apply if the Buyer is a legal entity.
To exercise the 14-day right of withdrawal, the product must only be used for its intended purpose. The consumer is responsible for maintaining the product’s quality and safety during the withdrawal period. If the product is misused, damaged, handled carelessly, or its original packaging is missing or significantly damaged, the online store reserves the right to reduce the refunded amount accordingly.
To exercise the right of withdrawal, contact us via email at shop@magentacharm.com within 14 days after receiving the goods.
For online stores that do not offer free returns, the following applies:
- The Buyer covers the cost of returning the product unless the return is due to an incorrect or defective item.
- The Buyer must return the goods to the Seller without delay, but no later than 14 days after submitting the withdrawal request.
- Upon receiving the returned goods, the online store will refund all payments to the Buyer immediately, but no later than 14 days.
The Seller has the right to withhold the refund until the returned goods are received or proof of their return is provided.
If the Buyer chooses a more expensive delivery option than the cheapest offered by the online store, the store is not obligated to refund the extra shipping cost.
The online store is not responsible for delays in order fulfillment or failure to fulfill obligations due to unforeseen circumstances beyond its reasonable control.
The online store reserves the right to refuse a sale and request the return of goods if the price displayed was significantly lower than the market price due to an error.
6. Consumer Rights Regarding Non-Conforming Goods
The online store is responsible for defects or non-compliance with contract terms within 6 months after delivery, provided that the issue existed at the time of delivery. The Buyer must inform the Seller of any defects within 2 months of discovering them.
The Buyer can submit a complaint by contacting the online store via shop@magentacharm.com.
The online store is not responsible for defects caused after delivery to the Buyer. If the goods are found to be defective and the Seller is at fault, the Buyer has the right to request repair or replacement at no additional cost.
If the product cannot be repaired or replaced, the Seller will refund all payments under the Distance Contract.
The Seller will respond to consumer complaints in writing within 15 days.
7. Processing of Buyer’s Personal Data
The online store processes only the personal data provided by the Buyer when placing an order (e.g., name, surname, email, etc.).
Personal data is shared with delivery service providers only to ensure order fulfillment.
If you have explicitly agreed to receive marketing communications, we may contact you from time to time with information about our services and latest offers. For this purpose, we may process your email address provided for marketing communication. The Buyer can unsubscribe from marketing communications at any time by notifying us via shop@magentacharm.com.
8. Dispute Resolution
For matters not covered in these Terms, the Buyer and Seller agree to comply with the laws of the Republic of Latvia.
Any disputes arising between the Buyer and Seller shall be resolved through mutual negotiations or correspondence. If a resolution cannot be reached, disputes shall be settled in the courts of the Republic of Latvia, in accordance with Latvian legal norms.
Disputes between a consumer and the Seller can also be referred to the Consumer Rights Protection Centre or the courts of the Republic of Latvia.
The Buyer also has the right to seek dispute resolution through European Union consumer protection institutions.
